Engineer and Her Workers Imprisoned in Tangier Over Smurf Custody Case

A sentence has been issued for engineer Mariam and her workers, with each receiving one year of imprisonment after being accused of vandalism, demolition, and assault. This follows a complaint filed by the director of the “Snafr” nursery in Tangier.

Mariam, her brother Walid, and her worker Aziz were sentenced to one year in prison, while a default judgment was issued against her other brother, Hamza. They are also required to pay 20,000 dirhams in compensation to the injured party.

The case has sparked widespread debate in the education and engineering sectors locally. After attempts to resolve the matter peacefully, it unexpectedly escalated to a criminal court, resulting in a prison sentence for a group of individuals.

### Case Details

According to reports, the “Snafr” nursery director had commissioned engineer Mariam to repair and prepare the educational institution for the current school year. A dispute arose when the director failed to pay the fees owed to the engineering company.

The case file indicates that, due to the director’s non-fulfillment of her commitments and failure to pay for the work as agreed, Mariam and her workers, including her brothers, attempted to restore the nursery to its prior state by demolishing a small wall built around a tree in the nursery’s garden on Gandhi Street.

The director’s defense argued that the workers’ entry into the facility was unlawful, highlighting instances of trespassing, vandalism, and demolition, which caused significant panic and fear for the elderly director.

In contrast, the engineer’s defense claimed that their client had not officially handed over her “project” to the director, thus maintaining her responsibility over the location. They asserted that her entry with the workers did not constitute trespassing or assault.
